Highlights of the 2023 Update include:

  • all legislation and annotations brought current to June 1, 2023
  • coverage of recent amendments to the Employment Standards Act and Regulation, including:
    • prescribed types of work falling under "hazardous work," which employers are prohibited from hiring for if the person is under 16 years of age
    • increases to minimum hourly wages
    • rules regarding validity periods for licences pertaining to employment agencies, talent agencies, and farm labour contractors
  • new annotations covering, among others, the following topics:
    • the time an employee spends fulfilling an employer's mandatory policy, such as a COVID-19 vaccination and testing policy, may not constitute "work" where the employer does not direct an employee to use a specific means to fulfill its policy
    • significant and arguably inordinate administrative delays before the Employment Standards Branch may not entitle a party to relief on that basis if the party is unable to demonstrate specific prejudice as a result of the delay
    • without proper authorization, employers may not deduct an employee's wages and substitute the amount owed to the employee in store gift cards
    • complaints before the Employment Standards Tribunal may engage human rights principles outside the jurisdiction of the Tribunal, such as an employer terminating an employee on the basis of her pregnancy, but the Tribunal is not precluded from dealing with such complaints under the Act
