    • it is a low bar to release a party from an implied undertaking so that evidence given during discovery in one proceeding may be used in a related proceeding (Norseyl Properties Ltd. v. Mirage Trading Corp., 2024 BCSC 1990)
    • in a class action proceeding related to alleged harassment of the class of flight attendants employed by the defendant, the Court ordered production of all documents related to harassment complaints involving flight attendants whether they had opted into the class or not, but not for all employees of the defendant (Lewis v. WestJet Airlines Ltd., 2024 BCSC 2398 (Chambers))
    • applications may be dismissed where demands for document production are made without reference to or grounded in the specific requirements of Supreme Court Civil Rule 7-1 (Hill v. Dhanda, 2024 BCSC 2145 (Associate Judge) and Singh v. Gupta, 2025 BCSC 1244 (Associate Judge))
