Master the strategies and tactics for handling experts and their evidence!
This course is designed for junior civil and criminal litigators who seek a comprehensive introduction to presenting expert evidence at trial. The course will blend theoretical issues with nuts and bolt practices matters. Topics will include: case law update, working with an expert, practice dos and don'ts, and Expert Evidence Rule 11 from the Supreme Court Civil Rules. A special feature of this year's program will be an expert evidence case study in the area of seatbelt defence. This case study will be used to illustrate strategic and tactical considerations in challenging an expert opinion, and will feature a demonstration cross-examination and an extensive debrief of the cross-examination. The course will conclude with an expert evidence practice panel which will address the entire spectrum of issues that counsel must face when presenting or challenging expert evidence. This course will reference the CLEBC publication Expert Evidence in British Columbia Civil Proceedings—Third Edition (may be ordered separately—registrants receive $46 off the regular price of the book—call Customer Service to order) and faculty papers.
