Mediation continues to be an important process in the course of litigation or instead of it. As the process becomes more sophisticated, it is important for counsel and solicitors to keep up with procedural changes, mediator styles, and their own techniques. How can counsel enhance their effectiveness in this important forum?
This course covers a number of areas. It will define the mediation field and describe its many variations of practice. It covers policies driving mediation as well as professional standards that apply. It looks at documenting confidentiality and formalizing agreement to participate in mediation. Then the course will engage in discussion of counsel skills and techniques to get the most out of the mediation process.
Finally, the course will include some experienced counsel to share their comments and answer your questions about how they use the process imaginatively to get solid, lasting outcomes for their clients.
After taking this course, you will:
- understand numerous variations of the mediation process
- consider and practice how to prepare clients for mediation
- expand your use of mediation to enhance outcomes beyond what a court could do
- increase your capacity to seek interest-based instructions useful in the mediation process
- learn skills useful at the mediation table to encourage mutually acceptable solutions
- consider how best to capture agreement and close the dispute
This course counts for 6 ADR CPD hours.
