Learning level: Advanced

Complex issues regarding estate planning will be explained, including discussion on inter vivos and testamentary trusts. The course will also look at the contemporary issue of estate planning for blended families.

With respect to estate administration, the course will review the procedures involved with various estate grants, including probate, administration with will annexed, administration without will annexed, resealing grants, and ancillary grants.

We will also be looking at applications under s. 58 curative provisions of the Wills, Estates and Succession Act, and how to deal with missing beneficiaries. The course will cover pre-grant steps and post-grant steps, including the passing of estate accounts and distribution.

Recent and relevant case law will be highlighted and materials will be prepared to assist in recognizing unusual or difficult problems relating to estate planning and administration.

Law Society of BC CPD Hours: 6 hours (this course will contain a minimum of 40 minutes pertaining to professional responsibility and ethics, client care and relations, and/or practice management)
