Litigation against the Crown comes with its own set of unique procedural and substantive rules. There are traps for the inexperienced and unwary. This course is designed to assist lawyers at all levels of experience in navigating such traps.
Substantive topics will cover: Crown liability, including the Crown's liability in negligence; "constitutional torts" (i.e., claims for Charter damages); misfeasance by Crown officers; and the policy/operations divide.
This course will also cover core topics in relation to procedure and remedies against the Crown. Who do you sue? In what court? Should you sue or apply for judicial review? Can you obtain injunctive relief? The answers to such questions are the building blocks for successful litigation against the Crown.
This course will be of interest to junior and experienced Crown litigation counsel alike.
Law Society of BC CPD Hours: 6 hours (this course will contain a minimum of 1 hour pertaining to professional responsibility and ethics, client care and relations, and/or practice management)
