The COVID-19 pandemic has given rise to unique conflicts surrounding parenting time, including compliance with provincial health orders, vaccine rejection, and denial of parenting time. With mask mandates now being extended to younger children, vaccines likely to be approved for children under 12, and the border to the USA opening, these disputes are sure to continue to arise.
Topics to be discussed:
- what amounts to "urgency" for the purpose of an application
- COVID-19 concerns related to parenting time/contact time
- transportation for parenting time during COVID-19
- international travel during COVID-19
- contested applications regarding whether to vaccinate children
- concerns regarding new partners and COVID-19
- the court's ability to take judicial notice of the state of the pandemic, the risk of contracting the virus, and the safety of the vaccine
- experts in applications of this type
