Who should attend: Civil and criminal litigators at all levels with some courtroom experience who want to enhance their courtroom skills and confidence.

Have you ever wanted to receive honest, personalized feedback from senior counsel and judges to take your advocacy skills to the next level? This is your chance to practice on your feet in a real courtroom.

Unlike any other course offered at CLEBC, senior colleagues of the bench and the bar will provide you with the ultimate mentoring experience by helping you elevate your advocacy skills in a relaxed, safe environment in this three-day workshop. Within a practical and hands-on framework, refine your skills and learn how to influence the people that matter at trial with this rare chance to experiment and make mistakes without cost to your client or reputation.

Over the course of three days, you will:

work through a civil mixed with criminal trial fact pattern and case materials by completing advocacy performance exercises in a small group led by a senior litigator team leader
experience the intellectual, ethical, emotional, and physical demands of trial by performing multiple and repeated direct examination, cross-examination, opening, and closing exercises in a mock courtroom setting
receive real-time critique regarding each of your performance exercises from team leaders and guest instructors
have a lifetime opportunity to be video-recorded for two of your performance exercises
receive individual attention and personalized, constructive feedback during one-on-one sessions with a senior member of the bench or bar who will review your video-recorded performances together with you
watch live demonstrations of proper trial advocacy skills performed by experienced faculty
act as a witness for other student performances to understand the witness experience at trial
have the opportunity to understand the perspective from the bench
dramatically improve your craft in a short time!

About the Course Chairs

The Honourable Madam Justice Catherine A. Murray is a graduate of UBC Law School and worked almost her whole career as Crown counsel. She received her QC designation in 2008 and was appointed to the BC Supreme Court in October 2016.

During her career with the Crown, she prosecuted many serious cases including the last two Kelly Ellard cases and the Surrey Six. She has been involved in teaching advocacy to Crown counsel around the province and through CLEBC for the past 15 years.

Andrew Nathanson (B.A. (UBC, 1992), LL.B. (University of Toronto, 1995)) is a partner with Fasken Martineau DuMoulin LLP in Vancouver. He practices in the areas of commercial litigation and white-collar crime. He has appeared before all levels of court, including the Supreme Court of Canada. Mr. Nathanson's practice includes complex commercial disputes, often involving claims for interim relief; shareholders' disputes; and fraud and other white-collar crime. Mr. Nathanson also has an interest in constitutional law. His public law cases have involved the constitutionality of Insite, Vancouver's supervised injection site; jury secrecy rules and when an acquittal may be set aside for a reasonable apprehension of bias; the validity of the Canada Elections Act ban on premature transmission of federal election results; civilian police oversight; the constitutionality of the offence of human trafficking in IRPA; and whether mandatory minimum sentences constitute cruel and unusual punishment contrary to s. 12 of the Charter. Mr. Nathanson is a former adjunct professor of civil procedure at UBC Faculty of Law, an honorary member of the U.K.’ s Commercial Bar Association and a CLE contributor in the areas of restitution, evidence and trial advocacy.

CASE STUDY:

Flames burst from the Dry Cleaner on Elm Street in East Vancouver. Spontaneous combustion? The insurance company pays out, but through the work of a private investigator gets a sniff of arson. The insurance company wants its money back. The police conduct an investigation and the owner and one of his employees are charged with arson.

You will practice your courtroom advocacy skills by completing performance exercises using witness statements, statements of defence, pleadings, indictments, police reports, and exhibits (including letters, cheques, a site diagram, investigator report, newspaper article, area map, witness criminal record, insurance company cheque, statement of loss, and claim letter).
