The COVID-19 pandemic has had a profound impact on many areas of Canadian life, including the administration of justice. One area in particular, is the administration of criminal justice. If there were challenges in criminal justice pre-COVID-19—they are even more pronounced in our current setting. How are we to conduct hearings and trials with strictures on social distancing? What is the impact of the risk of COVID-19 on persons facing pre-trial incarceration? What changes such as the adoption of video appearances can be made to the court process to give faster more efficient justice without sacrificing values such as fairness?
This course will focus on three important threads:
- the immediate impact of COVID-19 on substantive issues such as judicial interim release
- the use of technology to deliver modernized criminal justice process—from best practices to nuts and bolts details
- the larger question of what current process changes may mean for the longer-term reform of the administration of criminal justice
