This course explains the various forms of undertakings and considers:

  • Whose undertaking is it?
  • Who can relieve you of it?
  • Whose responsibility is it to discharge the undertaking if you leave the firm and the file stays behind?
  • Can an undertaking be imposed on you?
  • What are the considerations when giving or accepting an undertaking?
  • What happens when an undertaking goes wrong?

Note: This course was created before January 1, 2013, when the Professional Code of Conduct for British Columbia (the Code) replaced the Professional Conduct Handbook (the Handbook). The sections dealing with undertakings have not changed substantially.
