Who should attend: Judges, plaintiff counsel, defence counsel, corporate counsel, and in-house counsel thoughout western Canada who will be prosecuting or defending class proceedings.

Class proceedings continue to evolve as a powerful litigation mechanism, and the differences that exist in jurisprudence across jurisdictions makes the class action process extremely complex. As actions cross provincial borders, you will be faced with important strategic, tactical, and practice decisions, such as where to file and how to best manage the certification process. This course will prepare you to assess the full range of issues which come into play with class proceedings, from selecting the jurisdiction to file in and the representative plaintiff at the front end, to finalizing a settlement agreement or cost order at the back end. You will learn from leading counsel and jurists at the centre of emerging class action jurisprudence, and receive a comprehensive review of the issues, trends, and practices shaping class action litigation today.

At this course you will learn about:

  • current class action trends in Western Canada: BC, Alberta, Manitoba, and Saskatchewan
  • current class action trends in the Canadian heartland: Ontario and Quebec
  • issues and emerging jurisprudence surrounding the critical question: "What constitutes a class?"
  • the new area of suing for a statutory breach
  • old and new ethics and professionalism issues that can arise in class actions
