Strata Property Act section 118 provides that "reasonable legal costs" associated with registering or enforcing a lien may be added to the amount owing to a strata corporation by a delinquent strata owner. But what does "reasonable legal costs" mean? What does it include? Join us for this focused lunch time course and explore what "reasonable legal costs" a strata corporation can recover from an owner, how the process works, and what lenders can do to insulate themselves against such expenses. Counsel to the BC Court of Appeal case The Owners, Strata Plan KAS 2428 v. Baettig will discuss this case which reversed decisions below and held that "reasonable legal costs" is to be read expansively, meaning actual solicitor and owner client costs (subject to the standard of reasonableness). If you handle delinquent strata accounts, you need to understand this decision!
