Who should attend: Plaintiff counsel who bring actions against the Federal or Provincial Crown, litigation counsel who act on behalf of the Federal or Provincial Crown.

Learning level: Intermediate/Advanced

Litigation against the Crown comes with its own set of unique procedural and substantive rules, as well as traps for the inexperienced and unwary. Benefit from the experience of seasoned counsel as they navigate you through the Crown litigation process and show you how to avoid the pitfalls. At this course, you will cover substantive topics of Crown liability, including: the Crown's liability in negligence, "constitutional torts" (i.e. claims for Charter damages), and liability for interference with private property rights. You will also explore the answers to core procedure and remedy questions, such as: "Who do you sue?", "In what court?", "Should you sue or apply for judicial review?", and "Can you obtain injunctive relief?"; you will develop the building blocks for Crown litigation success.

After taking this course, you will be able to:

  • formulate your action with the proper defendant, in the proper court, with the proper action
  • determine if a matter requires a class action instead of an individual claim
  • understand the elements of a misfeasance in public office and how to proceed
  • understand the manner in which damages are framed and current trends with damages
  • recognize how to frame a remedy whether from the common law or the Charter of Rights
  • apply the elements that go into trial strategy for Crown litigation
