Who should attend: This course is appropriate for lawyers, mediators, parenting coordinators, tribunal members, or other professionals who participate in negotiations, mediations, and other collaborative decision-making processes with clients.
Learning level: Intermediate
Self-determination is a key concept in collaborative decision-making processes and presumes that clients are able to make informed decisions. In some instances, clients may have less opportunity to participate in decisions affecting them as a result of perceived challenges to their decision-making capacity. In many such cases, advanced mediation and/or advocacy skills or process adaptations could support much greater opportunities for client participation.
This 12-hour course examines a wide variety of situations in which parties require support to ensure that they are able to participate effectively in decision-making and will offer professionals the skills and process design knowledge to provide that support in negotiations, mediations, 4-way meetings, group conferences, and other collaborative processes.
Most lawyers, mediators, and tribunal members will work with clients with mental health concerns, addictions, or physical limitations affecting decision-making. Many will also work with clients who have experienced individual or transgenerational trauma, often without recognizing its impacts on their participation in a process. Some professionals will also have occasion to support children’s participation in processes, or work with clients experiencing or planning for age-related health concerns, including dementia. In all of these circumstances and more, clients can be supported to participate in processes that will impact their lives.
Learn how to support individuals who might otherwise be excluded from collaborative processes to participate effectively in decision-making that affects them.
