We all hear about the theoretical virtues of commercial arbitration, but when and how can you access them for your clients? How do you avoid the uncertainties and negatives that arbitration can have as well? The arbitration process has similarities to litigation but it also has significant differences. This course tackles the difficult issues that arise as you work your way through the process — it is intended as a practical roadmap for litigation counsel, in-house counsel, and corporate solicitors at all levels. This may be of interest to anyone who is thinking of or engaged in arbitration, no matter your level of experience.

At this course you will learn:

  • to unpack the critical front end decisions — whether to arbitrate and if so, the process of selection and engagement of an arbitrator or mediator-arbitrator
  • about arbitral institutions and what they can bring to the process
  • the critical issues in the arbitral process: costs arrangements, arbitral process arrangements, and the important issue of client confidentiality
  • the interplay between arbitration and the court process — from ignoring an arbitral clause to setting aside an award to seeking enforcement of an award
