The Franchises Act was passed by the BC Legislature in November 2015. The regulations to the Franchises Act have just been completed, and the Act and Regulations will come into force on February 1, 2017. This will be a significant change to franchising in BC, affecting both franchisees and franchisors. Franchisors will be required to produce and deliver to prospective franchisees a comprehensive disclosure document describing specific items of disclosure and all material facts relating to the franchise opportunity, similar to what franchisors must do in other Canadian provinces that have franchise-specific legislation. Meanwhile, franchisees will have the right to rescind franchise agreements for non-disclosure.
Join us to learn about the requirements of disclosure for franchisors, the remedies available to franchisees, and other matters, from the leading franchise lawyers in BC. You will also hear a lawyer from another jurisdiction speak about their experience with the implementation of similar legislation in their province.
At this course you will learn:
-
to whom the new Act applies
-
the timing and content of disclosure obligations of franchisors (including the review of a sample disclosure document)
-
the rights and remedies available to franchisees, such as misrepresentation and rescission claims, and available defences
-
traps for lawyers practicing franchise law
