The proliferation of electronic personal information, coupled with changes to federal and provincial law and shifting concepts of “public life” have resulted in an increase in litigation for “breach of privacy” arising out of unauthorized use and disclosure of personal information. Advances in technology have fundamentally altered the way people collect, store, and disclose “personal” information. Employees will commonly use their “work computers” for personal activities, which can often be tracked and accessed by employers. A person’s phone can contain a user’s location history, financial information, and increasingly, personal health information such as diet, exercise, and sleep habits, and can contain private photographs and videos.

This course reviews recent developments in privacy litigation in Canada, including a discussion of emerging claims in tort and contract, and identifies areas in which the law will change in the coming years. The program includes these topics:

Recent Developments in Privacy Law Cases

Civil Claims

  • breach of confidence
  • publicity given to public life
  • contracts
  • waiver of tort

Privacy Regulations

  • privacy expectations
  • importance of privacy policies—both internally and externally
  • review of sample privacy policies
  • privacy and data collection
    • forensic and non-forensic collections
    • social media collections

Law Society of BC CPD Hours: 1 hour
