Learning level: Intermediate/Advanced

This practice oriented course is designed to strengthen the skills of litigators in applying the laws of evidence in a trial setting. The interactive program will combine lectures, video presentations, demonstrations, and small group discussion to hone your ability to analyze evidentiary issues and apply evidentiary principles. Previous editions of this program received rave reviews, and this year’s will be no exception! The day will once again bring together an exceptional team of judges, academics, and senior practitioners for an intensive day on the law of evidence. The program begins with a presentation on the Principled Approach to the Law of Evidence delivered by the Honourable Mr. Justice Sidney Lederman of the Ontario Superior Court of Justice. The program will feature additional presentations on select topics in evidence. You will then break into groups of 10, each led by two faculty members, and analyze the evidentiary issues raised in a fact pattern. This course is a unique opportunity for counsel at all levels of experience to test and improve your evidentiary skills under the tutelage of a stellar teaching faculty. Course enrolment is capped at 70 in-person attendees because of the interactive aspect of the discussion groups.

At this course you will learn...

  • the principled approach to evidence
  • how to analyze problems in several critical areas of evidence: hearsay, privilege, and expert evidence
  • best practices for managing affidavit evidence
  • how to benefit from the personalized analysis and discussion of evidentiary issues in the breakout groups led by senior counsel and judges
  • how to increase your overall confidence and facility in tackling evidentiary issues
